The final regulations were announced today. These include major changes to
the skilled worker, business, and refugee class immigrant applications.
You should take it that all applications submitted from now on will be
considered under the new regulations. This is despite the fact that the new
regulations do not come into effect officially until 28 June 2002.
Please see below details of the latest changes by category.
Skilled Worker
- The points requirement is now set at 75 points
rather than the 80 points as set out in the proposed regulations of 15
December 2001. This will mean that more people can qualify under the
Independent Scheme.
- The new regulations increase the number of
points under the education factor for people who have a high level
diploma, trade certificate, or apprenticeship.
- You can now gain up to 24 points for language
ability rather than the 20 points under the proposed regulations.
- The number of points under the experience
factor has been reduced from 25 to 21 points. At the same time more points
will be awarded for those with one or two years of experience. This will
benefit younger applicants.
- You will now gain the maximum ten points for
the age factor if you are between the ages of 21 and 49. This will make it
easier for older applicants to qualify under this category.
Business Immigrants
- It has now become easier to qualify under the
investor category with management experience. You need to have showed that
you have managed at least five people compared to fifty in the old
regulations.
- Immigration officers will spend more time
verifying that the money accumulated by business immigrants was
"legally obtained".
Family Class
- The new "Conjugal Partners" category
will make it easier for unmarried partners to gain immigration to Canada.
- The Fiance category has been eliminated as the
number of applicants under this category is so small.
